1. Scope of the Terms & Conditions

These Terms & Conditions of Service (“Terms & Conditions”) apply to your (“Member”) use of and/or access to the SCALE Plan website, Online Services and Coaching Services (“Services”) for the duration of your Membership (“Membership”.)

If you are not willing to be (or cannot be) bound by these Terms & Conditions and any of the agreement outlined below you must not access, browse, or use these Services. SCALE Plan will not grant you any right to access, browse, or use these Services without your ability to abide by the Terms & Conditions of this agreement.

Members must use the Services with caution, common sense, and sound judgement. If Members do not abide by the Terms & Conditions, SCALE Plan reserves the right to immediately terminate a Member’s Membership and access to the Services. In such circumstances, all member information and files on the SCALE Plan website (“Member Profile”) will be removed from the site and access to any Services will be restricted, with or without notice, at the discretion of one of the SCALE Plan Coaches (“Coach”).

2. Change to the Terms & Conditions

SCALE Plan reserves the right to change, modify, supplement or remove parts of these Terms & Conditions (“Additional Terms”). Members will be notified of Additional Terms via email and on the SCALE Plan website. The Member will be deemed to have agreed to the Additional Terms by continuing to access and use the Services.

3. Change to Services

SCALE Plan reserves the right to change, modify, supplement or remove parts of the Services provided as part of the Membership. These changes will only be made to Services for the benefit of Members or to remove any Services that are found to be of detriment to Members. SCALE Plan will endeavour to notify Members of these changes prior to implementation, where it is reasonably practicable to do so. The Member agrees for changes to the Services to be implemented at SCALE Plan’s sole discretion.

5. Membership, Fees & Cancellation

SCALE Plan requires a minimum Membership commitment of 12 weeks. The payment of Membership fees (“Fees”) is scheduled as below: 

After 12 weeks, Memberships can be cancelled at any time. Members must notify their Coach that they wish to cancel their Membership. Members will continue to have access to their Member Profile until the final day of their last 4-week payment period.

All Fees are non-refundable except for circumstances outlined in the ELIGIBILITY Section of these Terms & Conditions. Membership prices will not be reduced if individuals are unable to use their Membership for any time during a month, including (but not limited to) illness, injury, work commitments, or holiday.

Upon completion of the registration process, Members are required to complete a questionnaire (“Onboarding Form”) that provides information about their current lifestyle and physical health. If the Onboarding Form indicates that a Member is unable to use the Services outlined in the ELIGIBILITY Section; then their Membership will be cancelled after discussion with a Coach and a full refund will be given as soon as possible.

Rates and prices of Membership can vary at any time at the discretion of SCALE Plan. Prior notice of changes to rates and prices of Membership will be provided on the Website or via Email.

6. Provision of Services

SCALE Plan aims to provide Services that accommodates to the needs of Members within reasonable limits.

This includes:

SCALE Plan does not provide professional services for diagnosing and providing clinical treatment for physical or psychological conditions. Members with concerns about their physical or mental health should consult with their General Practitioner in the first instance.

7. Support Session Cancellation

Support Sessions will be arranged in advance between the Coach and Member at a time that is suitable for both parties.

Scheduled Support Sessions will not be extended due to the lateness of the Member, or disruptions to the session caused by the Member. Members who are more than 20 minutes late to a scheduled session with their Coach will be deemed to have cancelled that session and the Support Session will not go ahead.

If the Member needs to cancel or rearrange a scheduled Support Session, they must do so by contacting their Coach via their Member Profile at least 24 hours before the scheduled start of the session.

8. Standards and Conduct

Members are required to adhere to the standards (“Community Standards”) outlined below.

Members must not:

  1. Upload, post, email, or otherwise transmit any materials that are:
    • unlawful, harmful, threatening, abusive, harassing, inflammatory, tortious, defamatory, vulgar, libellous, slanderous, discriminatory, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable at the discretion of SCALE Plan.
    • contain adult content, including obscene, pornographic, and/or sexual terms, descriptions and/or images, nudity, profanity or graphic violence.
    • are not your own, or that you do not have a right to upload, post, email or otherwise transmit under any law or under contractual or fiduciary relationships (such as insider information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements).
    • infringe upon any patent, trademark, trade secret, copyright, right of privacy or publicity or other proprietary rights of any party.
    • are unauthorized advertising, promotional materials, “junk mail,” “spam,” “phishing,” “chain letters,” “pyramid schemes,” or any other form of solicitation, opinions or notices, commercial or otherwise.
    • contain software viruses, spyware, adware, worms, or any other computer malware or malicious code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
  2. Impersonate any person or entity, including, but not limited to any Member or affiliate of SCALE Plan. This includes creating more than one unique Membership, registering for more than one account, creating an account on behalf of someone else, or creating a false or misleading identity.
  3. Use or affect the Services in any manner that could damage, disable, overburden or impair the Services or its functionality, or disrupt the normal flow of dialogue (including, without limitation, “flooding,” “mail bombing,” or “crashing”), or otherwise act in a manner that negatively affects or otherwise diminishes the quality of another user’s experience of the Services.
  4. “Stalk” or otherwise harass another Member or Coach.
  5. Solicit, collect or post personal data or attempt to solicit, collect or post personal data about other Members or Coaches. This includes access or attempts to access another Member’s account without his or her consent.

Use of Services depends on the Member’s compliance with the Community Standards. Misconduct and violation of Community Standards will lead to termination of Membership.
